CFSW Anti Collusion Management Strategy
Pre Qualification Questionnaire (PQQ) Stage of Applications
- Completion of a PQQ Anti Collusion Certificate by all applicants
- Confirmation from all applicants if they are identified as one of the companies listed within the Office of Fair Trading's Investigation and what is the current position between the company and the OFT
- Confirmation from all applicants if the company is subject to any legal proceedings pending against them as a result of the OFT investigation
- Clear notification to contractors that if they have made misleading statements to CFSW in relation to collusion this may result in their later suspension and or removal from CFSW framework
- Plus independent third party review* primarily of PQQ applications and the PQQ evaluation processes and limited review of OFT investigation position.
Invitation to Tender Stage (ITT) Applications
- Completion of an ITT Anti Collusion Certificate by all applicants
- Confirmation from all applicants if the company has become subject to any legal proceedings pending against them as a result of the OFT investigation since the PQQ was returned
- Confirmation from all applicants if internal guidance has been provided by the company to bid managers and other staff in relation to probity within the bidding process
- Clear notification to contractors that if they have made misleading statements to CFSW in relation to collusion this may result in their later suspension and or removal from CFSW framework
- Plus independent third party review* primarily of ITT applications and the ITT evaluation processes and limited review of OFT investigation position.
Operational Stage of Framework
- Completion of an Anti Collusion Certificate by contractors confirming they will not collude to secure any of the contracts let via the CFSW framework. These Certificates may be viewed by signatories and the Public Body Agreement on the secure area of the Website.
- Completion of an Anti Collusion Certificate by all sub contractors bidding for sub contract packages
- Clients and contractors will agree the acceptable minimum numbers of quotes or tenders required to demonstrate value for money for sub contract packages
- Agreement to be given for the framework management team to have ‘open book access’ to all tender bids and the background papers to support tender bids, (clear notification to be provided that background papers supporting tender bids to be retained in all cases by contractors)
- The framework management team will randomly review tender bids for sub contract packages and potentially investigate further if suspicious patterns of bidding emerge
- Agreement that if the organisation becomes subject to any legal proceedings against them as a result of unfair practices they must inform the Framework Management Team within 7 days
- Agreement that internal guidance will be provided by the contract organisation to all bid managers and other staff in relation to probity within the bidding processes
- Clear notification to contractors and sub contractors that if they have made misleading statements to CFSW in relation to collusion or have colluded to secure CFSW works this will result in their suspension and or removal from future CFSW framework
- Plus independent third party review* of samples of sub contractor tenders & associated evaluation processes.
(* - The independent third party reviews mentioned above are likely to be
carried out by external auditors engaged from time to time by the CFSW Project
Board)
